Binding Agreement

When receiving in-home services, you agree to provide safe and reasonable access to your property. You are responsible for informing us of any hazards, special conditions, or restrictions at your property that might affect service delivery or staff safety. This includes but is not limited to pets, security systems, fragile items, or structural issues.

1.5 Compliance with Laws

You are responsible for ensuring that your use of our services complies with all applicable laws, regulations, and local ordinances. This includes any homeowners association rules, rental agreements, or other legal obligations related to your property.

2. Liability, Warranties, and Disclaimers

2.1 Service Disclaimers

Our services are provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, completeness, or timeliness of our services. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to:

2.2 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Renew Home, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of our services.

2.3 Damage and Loss

While we carry insurance and train our staff carefully, we cannot be held responsible for pre-existing damage, wear and tear, or damage resulting from conditions we were not informed about. You agree to conduct a reasonable inspection of your property before and after service and to report any concerns within a reasonable timeframe. Claims must be reported within 24 hours of service completion to be considered.

2.4 Maximum Liability Cap

Our total aggregate liability to you for all claims arising from or related to our services shall not exceed the total amount you paid to Renew Home for the specific service giving rise to the claim, or one hundred dollars ($100 USD), whichever is greater.

2.5 Third-Party Services

Our website may contain links to third-party websites or services that are not owned or controlled by Renew Home. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

3. Indemnification

You agree to defend, indemnify, and hold harmless Renew Home and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms and Conditions
  • Your violation of any third-party rights, including intellectual property rights or privacy rights
  • Any claim that your use of our services caused injury or damage to a third party
  • Your provision of false or misleading information to us

4. Legal Framework and Dispute Resolution

4.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States, without giving effect to any principles of conflicts of law. Your use of our services may also be subject to other local, state, national, or international laws.

4.2 Jurisdiction and Venue

You agree that any legal action or proceeding between you and Renew Home for any purpose concerning these Terms and Conditions or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in the United States, and you consent to the personal jurisdiction of such courts.

4.3 Dispute Resolution Process

In the event of any dispute arising from these Terms and Conditions or your use of our services, you agree to first attempt to resolve the dispute informally by contacting us. We are committed to working with you to reach a fair and reasonable resolution. Most disputes can be resolved through direct communication and good faith negotiation.

4.4 Waiver of Class Actions

You and Renew Home agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

4.5 Severability

If any provision of these Terms and Conditions is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.

4.6 Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms and Conditions due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or governmental actions.

5. Modifications and Termination

5.1 Modifications to Terms

We reserve the right to modify or replace these Terms and Conditions at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after revisions become effective, you agree to be bound by the revised terms.

5.2 Service Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use our services will immediately cease.

Assignment: You may not assign or transfer these Terms and Conditions or your rights hereunder without our prior written consent. We may assign or transfer these terms at our sole discretion without restriction.

Headings: The headings in these Terms and Conditions are for convenience only and have no legal or contractual effect.

Language: These Terms and Conditions are written in English. Any translated version is provided solely for convenience. In the event of any conflict between the English version and a translated version, the English version shall prevail.
